Definitions

“Platform” means the Abher app and website. “Captain” is the boat owner or operator offering trips through the Platform. “Guest” is the user booking a trip. By using the Platform you agree to these terms.

Nature of the Service

Abher is an intermediary platform connecting guests with captains for sea trip bookings. The captain is responsible for operating the trip, its safety, and required licenses; the Platform facilitates booking and payment only.

Booking and Payment

A booking request is sent to the captain, who may accept or decline it. Upon acceptance, the guest must pay the booking amount through the payment methods available on the Platform. A booking is confirmed only after successful payment.

Cancellation and Refunds

If the captain cancels after payment, the guest receives a full refund. If the guest cancels more than 48 hours before the trip, the amount is refunded minus any processing fees; within 48 hours, refunds are subject to the captain's policy. Refunds are issued to the original payment method.

Guest Obligations

Guests must arrive on time, follow safety instructions from the captain, not bring prohibited items, and bear responsibility for any damage they cause.

Captain Obligations

Captains must ensure the accuracy of listed trip and boat details, maintain valid licenses and insurance, provide safety equipment, and deliver the trip as advertised.

Limitation of Liability

The Platform is not liable for damages arising from trip operation, weather conditions, or the negligence of any party. In all cases the Platform's liability is limited to the paid booking amount.

Governing Law

These terms are governed by the laws of the Kingdom of Saudi Arabia, and its courts have jurisdiction over any dispute arising from them.
